Governmental Liability

Hurrell Cantrall LLP’s government liability practice includes the defense of law enforcement officers and governmental entities against claims of civil rights violations under 42 U.S.C. § 1983 for unlawful arrest, excessive force, and cruel-and-unusual punishments, as well as unconstitutional customs and practices involving allegations of negligence, battery, false imprisonment, supervisory liability, and malicious prosecution.

Our attorneys have specialized experience and knowledge involving claims of alleged constitutional deprivations, including violations of rights secured by the First, Fourth, Fifth, Eighth, and Fourteenth Amendments. Moreover, our attorneys are well versed in the California Government Tort Claims Act and all available defenses and immunities.   Mr. Hurrell and Ms. Cantrall were named as the Attorney of the Year in 2007 and 2003 respectively by the Los Angeles County Sheriff’s Department for their successes in litigating such cases.

  • Defense verdict following a federal court trial where the plaintiff alleged unlawful arrest and excessive force resulting in a head injury after law-enforcement officers arrested him during a party at his home.
  • Motion for Summary Judgment granted in favor of a municipality, custodial deputies and medical staff in a case where plaintiff alleged negligence after cleaning solution was splashed into his eyes, leaving him blind in one eye. 
  • Plaintiff alleged racial conspiracy and violation of his 4th Amendment rights after he was arrested for domestic violence.  A defense verdict followed a jury trial in federal court.
  • Defense verdict in a case where plaintiff claimed severe nerve damage to his wrist due to excessively tight handcuffs, after law-enforcement officers executed a felony-stop pullover.
