Summary Judgment on Case of Alleged Dangerous Condition of Public Property After Injuries from Basketball Game

July 31, 2016

On behalf of a public entity that owned a gym, we prevailed on summary judgment based on the hazardous recreational activity immunity prescribed by Government Code § 831.7, in a case where the plaintiff was injured when he he collided with a glass trophy case placed near the outer limits of the basketball court in the gym.  Plaintiff alleged that the placement of the trophy case constituted a dangerous condition of public property.
