Dismissal in Personal Injury Lawsuit

July 30, 2017

Plaintiff allegedly slipped and fell at a winery. The winery filed a cross-complaint against our client who hosted an event at the winery at which plaintiff fell.  The winery made claims for express indemnity, implied indemnity, contribution, and declaratory relief.  After filing a demurrer, the winery dismissed the claims for implied indemnity and contribution.  After further negotiations and a threat of a motion for summary judgment and motion for sanctions, all remaining claims against our client were dismissed.
