Defense Verdict on Excessive Force Case Brought by Jail Inmate
September 18, 2013The plaintiff alleged that, while incarcerated at a jail, he was subjected to excessive force by various sworn officers. The plaintiff sued the public entity and the officers who were involved in the incident for violation of his civil rights and various state law claims. We filed a demurrer for the public entity, which was granted without leave to amend. The action proceeded to trial against the individual defendants. We argued that the force used was reasonable in light of the circumstances. The trial resulted in a defense verdict. The plaintiff appealed and we handled the appeal. The appellate court affirmed the verdict.
